I have now received a reply from David Newman to my letters of 4 July and 8 August together with copies of the relevant sections of the Deed of Amendment implemented in February 2000. David goes on to explain that this deed was not authorised in a Court of Law but merely drawn up by the Pension Plan lawyers. Extensive legal advice having been taken by the trustees.
He further states that the rights of the members of Defined Benefits section of the Main plan are not affected by the change.
I will get Nigel to scan in the sections of the Deed of Amendment and you can draw your own conclusions to this statement.
I found it interesting that the Deed made no reference to sections of a Main plan but clearly refered to C Plan and M Plan as though they were separate Plans.
