I would like to know which "specific exemption" allows the C Plan Max as I can't see one in the government's guidance.
Also, The Trustees are actually given new powers to force changes in pension plans as the following extract indicates

Trustees or managers are also given the power to amend any rules of the scheme to ensure they comply with the non-discrimination rule. Where changes to the scheme would require the employer's consent if made under the rules, the trustees or managers must ensure consent is obtained before using the amendment power under the Regulations. If the employer does not agree to amend the scheme rules, the nondiscrimination rule will automatically level up benefits accrued after 1 December 2006.
