I can't say much about what was said at Trustee Meetings about the age discrimination legislation, but I can say:
1. you raise a good point
2. the legislation is very complex - the Trustee (and no doubt IBM) has spent a lot of time dealing with its ramifications
3. there are lots of exemption clauses (in Schedule 2 - see link below) that allow employers and/or schemes to continue to use rules that would seem to breach the spirit of the legislation
4. I suggest that you write to David Newman asking him what has been decided in this particular case.
