The Barrister route was to satisfy ourselves that there was NO case. Maybe there is a case, we will probably never know!
If you look at the USA Employees/Retirees have challenged IBM in the courts and won.
: : My thinking was that an opinion from a barrister would allow us to know whether we had any chance to take on IBM legally, whether there was an alternative strategy we should pursue. A leader could help us organise.
: : I had hoped that being organised with a specialist legal adviser would result in the "specific workable ideas" you desire being formulated.
:
: Given the cumulative effect of IBM's actions in recent years, I believe that members have a strong moral case, even if the company has followed the letter of the law. Our problem is how to convert a strong moral case into action or the threat of action which would persuade IBM to think again.
: The last thing the company would want is former employees protesting outside its offices, or its white-collar workers drumming up support for joining a union.
