The limit is not imposed by regulation, it is an assessment of capacity assembled from and generally agreed to by professionals working in the area. The government is sufficiently confident of the assesment to use it in their decision making.
The figures are approximate, but to offload the C-Plan the capacity would have to be an order of magnitude larger, so it is unlikely to happen quickly. If it should happen later, the financial relevance of increases on pre-1997 service will have been reduced by then.
I think £500m capacity is a good number to use in assessing the propects of any buy-out of the C-Plan.
