From the report it looks like our case is lost:-
"The Trustee has received the Ombudsman's preliminary conclusions and remains confident that it has acted in accordance with its legal obligations and the likelihood is remote that the Ombudsman's final determination will have any adverse impact on the funding and net assets of the Plan"
