I'm still not clear about one part of the original question.
What I'm still unable to see is, assuming that we lose at Ombudsman level, where will the impetus come from to pursue through the higher courts and who will start the action, and where will the cash to fund the action come from? My fear and instinct is that there doesn't appear to be a large group of people amongst plan members to make a noise and fight.
