9. Mr Mitchell also made a number of complaints about the composition and partiality of those directors of the corporate Trustee (the trustee-directors) who were appointed by IBM. Dr Marks claims that the choice of trustee-directors has contributed to the issues described at paragraphs 11 and 12 and says that the Trust has done what IBM wanted.
You will know from the complaints and newsletters that the information we provided about the directors was not the complaint itself but information in support of the complaint. The complaint itself was that the directors had not managed their conflicts of interest successfully. The information was about why that was more likely to be the case.
Saying that the Trust has done what IBM wanted is not in itself a complaint - what IBM wanted could theoretically be in the members' interests. The complaint is that the Trust did what IBM wanted as a matter of policy, irrespective of other factors. This is called "misdirection", as you will know from the complaint on the website. This misdirection is demonstrated by the Trust's pattern of behaviour.
Remember the Ombudsman can proclaim what our complaints are, and even if that is totally contradicted by the written complaints and their authors, there is no appeal.
