10.        Mr Mitchell also contends that the decision to establish the M Plan and its implications were not fully and frankly communicated in a timely way to members.

A weak way of putting it.  This complaint was also explicitly made by Dr Marks.  The members were left to make the natural assumption that the M-Plan was separately funded, and what communications there were supported that view rather than contradicted it.
